Terms and Conditions — Upperview Media LLC

By booking a shoot, using our content creation service, or otherwise engaging Upperview Media LLC ("Upperview Media," "we," "us," or "the Photographer") for photography, video, or content production services, you ("Client") agree to the terms below. This forms a binding agreement between you and Upperview Media.

If you do not agree to these terms, please refrain from booking or using our services.

1. Copyright and Ownership

Upperview Media LLC owns the copyright to all photos, video, floor plans, and other media it produces. Booking a shoot grants the Client a license to use the media as described below,  it does not transfer ownership or copyright.

Upperview Media may use any images or footage produced for portfolio, marketing, and promotional purposes, unless the Client requests otherwise in writing.

2. Using Your Real Estate Media

The Client who paid for the shoot may use the delivered media to market the specific property listed, electronically or in print.

Residential listings: license runs until the property sells, or for one year from the shoot date, whichever comes first.

Commercial properties and short-term rentals: license runs for five years from the shoot date.

Reuse beyond these terms (e.g., relisting after the license expires, using the same media for a different listing) requires a new shoot or written permission from Upperview Media, and may involve a relicensing fee.

Media cannot be sold, sublicensed, or given to any third party — including other agents, brokerages, or vendors — without written permission. Licenses are not transferable.

Media may not be further edited, altered, or processed by anyone other than Upperview Media without written permission. This includes virtual staging, object removal, virtual renovations, upscaling, or running the media through AI tools of any kind.

3. Booking, Expectations, and Rules

Properties should be shoot-ready before our arrival (see our Property Preparation Checklist, if provided). Upperview Media is not responsible for physical staging, moving furniture, cleaning, or landscaping unless arranged in advance for an additional fee.

Cancellations or rescheduling requests made within 24 hours of the scheduled shoot may incur a fee.

Rescheduling due to weather (rain, snow, heavy fog, or other conditions unsafe for equipment or travel) is allowed without a fee.

Rush requests made within 12 hours of a desired shoot time may incur an additional charge.

4. Delivery and Turnaround

Photos are typically delivered the next morning by 9:00am.

3D tours and floor plans are typically delivered within [12-36 hours] of the shoot.

Video and other media are typically delivered within [48–72 hours].

Download access to delivered media remains available for as long as the listing is active, or up to one year (five years for commercial/short-term rental properties), whichever comes first. After that window, a relicensing or file-retrieval fee may apply.

5. Extra Charges and Right to Refuse Service

Properties located outside our service area are subject to a travel fee.

Upperview Media reserves the right to decline service at its discretion.

6. Payment Terms

Payment is due at booking or at Media delivery. Media is released/shared upon receipt of payment.

Media will not be released for delivery without payment settlement.
